The HELPICOACH application developed by ACTIFIT SRL is destined to sports coaches and other professionals who operate with subscriptions (hereinafter “the Professional(s)” and “the Application”). To this end, ACTIFIT collects and processes the data of the Professionals. The purpose of this Privacy Policy is to provide information about this data processing.
- The controller- ACTIFIT SRL, whose registered office is located at Chaussée de Waterloo 715, Box 31, 1180 Brussels, Belgium (registered with the ECB under number 0880.848.288) is the controller of the personal data of the Professionals who use the Application.
- Personal data processed- ACTFIT only collects and processes the personal data of Professionals. Under no circumstances does ACTIFIT collect or process the personal data of Professional clients.
ACTIFIT only collects the data that the Professionals have personally communicated to it. These are identification data (surname, first name), contact data (address, telephone, e-mail) and invoicing data (VAT, IBAN) – hereinafter “the Data”.
The Professionals are solely responsible for processing the data of their clients that they enter in the “notes” section of the Application. It is their responsibility to take all measures to comply with the General Data Protection Regulation in this respect, in particular the information of the persons concerned.
- Purposes of the processing- The Data are processed by ACTIFIT only for the subscription to the Application, for the execution of the contract concluded, to respond to information requests from the Professionals and when the processing is necessary for ACTIFIT to comply with a legal obligation. These processing operations are based on articles 6.1, a, b), and c) of the GDPR (General Data Protection Regulation of 27 April 2016).
- Access to the Data and communication to tiers- Only ACTIFIT’s information provider may have access to the Data but only to solve a possible problem in the functioning of the Application or to ensure its maintenance. ACTIFIT shall not communicate the Data to any third party.
- Duration and place of storage of the Data- The Data is hosted by AMAZON in Europe. The Data are only kept by ACTIFIT for the duration of the contractual relationship (subscription to the Application) and the period necessary to allow ACTIFIT to comply with its legal obligations to keep records (including accounting and tax records). This period will be extended for the management of a possible litige.
- Rights regarding Data- Professionals have the right to request access to their Data, rectification of Data that is inaccurate or incomplete, erasure of Data under the conditions set out in article 17 of the GDPR or a restriction of the processing of Data under the conditions set out in article 18 of the GDPR. The Professional may also object to the processing of his Data under the conditions set out in article 21 of the GDPR and has the right to request a copy of his Data to be transferred to another controller in the cases set out in article 20 of the GDPR.
The Professional has the right to lodge a claim with a supervisory authority. In Belgium, the supervisory authority is the “Data Protection Authority” www.autoriteprotectiondonnees.be.
